1. Scope of Application & Contract Parties 1. These General Terms and Conditions for Guest Accommodation (hereinafter "GTC") apply to contracts for the temporary rental of apartments for accommodation purposes, as well as all additional services and deliveries provided by Interiorapartments by T-D (hereinafter "Interiorapartments" or "Provider") to third parties (guests). The Provider's services are rendered exclusively on the basis of these GTC. 2. Subletting or further rental of the provided apartment, or its use for purposes other than residential, requires the prior written consent of the Provider. 3. The guest's terms and conditions apply only if expressly agreed in advance. Deviations from these terms are effective only if the Provider confirms them expressly in writing. ## 2. Accommodation Contract / Reservations / Booking 2.1. The accommodation contract is concluded when the Provider confirms the guest's booking request by phone or in writing via email, thereby accepting the booking. 2.2. The contracting parties are Interiorapartments and the guest. If a third party books on behalf of the guest, that third party is jointly and severally liable to the Provider for all obligations under this contract, provided the Provider has received a corresponding declaration from the third party. 2.3. The guest must check the booking confirmation for accuracy. If the confirmation deviates from the booking request and the guest does not object immediately (within 24 hours), the content of the confirmation is deemed contractually agreed. 2.4. Offers by the Provider regarding available apartments are non-binding. The Provider may refuse to enter into an accommodation contract at its discretion. 2.5. If the guest books only a category in an offered property, the guest has no claim to a specific apartment/unit. Interiorapartments reserves the right to industry-standard restrictions such as minimum stays, booking guarantees, or deposits for certain travel dates. ## 3. Cancellation Periods / Guest Withdrawal / No-Show 1. A guaranteed reservation exists upon receipt of the guest's payment. A guaranteed reservation can be canceled free of charge by the guest according to the specified cancellation conditions. After the cancellation period expires, cancellation is excluded, and the Provider retains the claim to the agreed remuneration minus the cleaning fee. 2. The guest may cancel free of charge without triggering payment or damage claims by the Provider up to 14 days before arrival. 3. For bookings of at least 2 apartments in combination during the same period, the following cancellation periods apply: Free up to 90 days before arrival. Within 90 days: 25% of total price minus cleaning fee. Between 60 and 30 days: 50% minus cleaning fee. Within 30 days: 100% minus cleaning fee. 4. Guest withdrawal from the contract requires the Provider's written consent. Without it, the agreed price is due even if services are not used (no-show), unless due to Provider delay or impossibility attributable to the Provider. 5. For same-day arrival reservations, payment per §5 must be made immediately, typically within one hour. ## 4. Accommodation Prices & Other Prices 1. Prices indicated by Interiorapartments at contract conclusion apply. These are gross total prices including all statutory taxes, fees, and levies. Local taxes payable by the guest, such as tourist taxes, are excluded. 2. The Provider reserves the right to adjust prices for changes in tax/fee rates or new unknown taxes. For consumer contracts, this applies only if more than four months pass between booking confirmation and adjustment. ## 5. Payment Terms & Invoicing 1. The full price for booked accommodation services must always be paid in advance by the guest. 2. Guest set-off is excluded unless against undisputed or final claims. 3. Valid payment methods: credit card, PayPal, instant transfer/Klarna, bank transfer – cash payments excluded. 4. Interiorapartments reserves the right to charge stored payment methods for additional services or GTC violations. The guest expressly authorizes this. 5. Booking implies guest consent to receive invoices as download or via email. ## 6. Use of Reserved Apartments 1. A reserved apartment is available during the specified period post-booking. 2. Unless otherwise agreed, keys must be returned to the key box or apartment on departure day. Lost keys or cards incur a €40 fee. The Provider may claim further damages exceeding €40, including lock replacement if required for security. Guests may prove lesser/no damage. 3. Late check-out may be arranged in advance subject to availability, with €10 per started hour if approved; otherwise €30 per hour. After 3:00 PM without approval: full day rate plus damages. No contractual right to late check-out. 4-5. Early check-in similar terms: €10 per hour if approved, no contractual right. 6. On departure, vacate by 10:00 AM unless agreed otherwise. Late: €50 (10-12 PM); 100% daily rate after 12 PM, plus further damages. ## 7. Assignment, Rental, Use 1. Subletting, resale, or transfer of apartments is prohibited, including at higher prices or false booking details. Provider may cancel such reservations. 2. Use for non-accommodation purposes, commercial/illegal activities, or unapproved photo/video is forbidden. Provider may cancel without refund. ## 8. Liability of Interiorapartments 1. Unlimited liability for damages to life, body, health; intentional/gross negligence; typical foreseeable damages from cardinal duties. Other claims excluded unless specified. 2. Provider remedies defects promptly upon notice; guest must mitigate. 3. Liability for guest items per statute; claims lapse without prompt notice. Special agreement needed for valuables >€800 or items >€3,500. 4. No custody for parking; liability only for intent/gross negligence. 5. Claims generally prescribe in one year; exceptions for health/intent/gross negligence/cardinal duties. 6. No liability for lost property except intent/gross negligence. Storage 6 months for fee; then disposal. ## 9. Deposit 1-4. Security/deposit: €250 (<3 months); one month's rate (3-6 months). Pre-authorization possible; non-payment allows refusal/termination. Settled within one month post-contract. ## 10. Guest Data 1-3. Mandatory collection: email, phone, ID (passport for foreigners), card data. Fraud prevention score used; suspicious bookings cancellable. ## 11. Termination of Accommodation Contract 1-4. Provider may terminate for cause (force majeure, fraud, safety risks, illegal use, resale). No damages; future bookings cancellable. ## 12. No-Smoking Policy 1-4. All areas non-smoking (incl. e-cigs/shisha). €250 cleaning/damages; higher if proven. Manipulation of safety: €150. Immediate termination possible. Full liability for false alarms. ## 13. Quiet Hours 1-5. No noise, esp. 10 PM-7 AM. No parties. €500 damages for violations. Sensors/cameras monitor. Immediate termination; third-party enforcement costs charged. ## 14. Damage or Theft 1. Damages beyond normal use, removal of inventory: full compensation incl. cleaning, lost revenue, €50 fee. Guest may prove lesser/no damage. ## 15. Pets 1-4. No pets except service animals (proof required). Unauthorized: €150 fee. Immediate termination. ## 16. Maintenance 1-5. Careful use required; extra cleaning €50+. Report defects/damages. Weekly cleaning for >7 nights. Liability insurance recommended. ## 17. Internet Use 1-4. Access provided; no liability for disruptions. No illegal/abusive use (P2P, etc.); guest indemnifies. No sharing credentials; blocking possible. ## 18. Personal Data Collection 1-8. Details on data processing per GDPR. Controller: Interiorapartments by T-D. Rights: access, rectification, etc. Complaint to Bavarian authority. ## 19. Final Provisions 1-7. Amendments in writing. Venue/performance: business seat. German law. Invalid clauses replaced.
